Recognition — Effects of Non-Recognition — Non-Recognition of the Union of Soviet Socialist Republics by Roumania.

The Facts.—This was a case arising out of the Soviet Decree of May 2, 1918, providing for the nationalisation of companies. Roumania had not in 1932 recognised the Soviet Government. The case concerned a Russian company. It was sought to establish its dissolution in accordance with the Decree.

Held: that the Court could not take note of the dissolution. The Government of Russia not having been recognised by. Roumania, the Roumanian courts could not be expected to apply Soviet legislation. Moreover, the Decree, which ordered the confiscation of private property, was contrary to the public...
