Abstract: The regulation of a special legal liability for dignitaries and magistrates is in a conditional

relationship with the existence of a real separation of powers, being one in consideration of the

mandate. Thus, while the President of the Republic enjoys absolute and perpetual irresponsibility,

similar to that recognized by the Romanian deputies and senators for the votes and political opinions

expressed in the exercise of their mandate, members of the Government, th e exception of those who

are at the same time members of Parliament, do not enjoy irresponsibility for their actions. As for the

magistrates, they are covered by such protection , in the case where they have not acted in bad faith or

with serious negligence.

pouvoir des procédures de droit commun régissant l‟engagement de la

responsabilité, soit par l‟interdiction d‟en poursuivre quelques-unes, soit par

l‟octroi d‟un privilège de juridiction. Aucune de ces deux notions ne conduit à la

Ayant des racines dans le droit médiéval, par rapport aux privilèges octroyés par l‟Eglise,

l‟immunité désigne le fait de soustraire une personne ou une chose à l‟application des règles de droit

commun.

La consécration de cette notion doit être corrélée avec la personne du monarque, intangible grâce à

sa liaison avec la divinité (Draganu, 1998, p. 300).
